Registration is the Law

As of January 1, 2007, all Mortgage Brokers doing business in the state of Colorado are required to register with the Colorado Division of Real Estate. You can search for a registered broker by following this link: Search for a Broker.

Please note: There are several exemptions to this rule:

  • Employees and agents of federally regulated banks, savings and loans and other lending institutions.
  • A Federal Housing Administration approved mortgagee or an appointed Federal Housing Administration correspondent, acting through officers, partners, members, exclusive agents, contractors, or employees of such entities when making or brokering any mortgage loan;
  • Employees of the Federal Government or Colorado State Government
  • Attorneys, licensed in Colorado, who are not primarily engaged in the business of negotiating residential mortgage loan

Those meeting the above criteria are exempt from registering.

Special Notes:

  • The FHA exemption was repealed June 1, 2007. All Mortgage Brokers doing business in Colorado are now required to register with the Colorado Division of Real Estate.
  • Also, starting January 1, 2008, all Mortgage Brokers doing business in Colorado will be required to be licensed. Please check back as more information is made available.
